Document #EFTA00098091: Official Said ‘Kill That Dude’ After Jeffrey Epstein’s Death

A newly released FBI document shows that an inmate at the Metropolitan Correctional Center heard a prison guard say “he killed this guy” the morning Jeffrey Epstein was found dead, then heard a female voice say that if he is dead, it will be covered up and the police will be given an alibi.

The Miami Heraldwhich first reported the text, says the inmate identified the female voice as Tova Noel, one of two guards assigned to guard Epstein’s cell that night.

A full summary of the 5-page FBI interview is published below. Before that, some context on who Noel is and what else the released files show about him.

Noel was 30 years old and had been working in Epstein’s Special Housing Unit for 23 days when Epstein died. He and fellow officer Michael Thomas were the two guards assigned to guard his cell that night. Federal investigators determined that none of them performed the required 30-minute checks. They had been sleeping for hours browsing the internet. They falsified log records to show that they had done their duty.

That was the basis of their criminal charges. Both were later dismissed after Noel completed 100 hours of community service and cooperated with a general investigation by a DOJ inspector.

Exempted files go beyond what is covered by the charges.

FBI records show that Noel searched for “latest epstein in prison” at 5:42am on August 10, 2019, and again at 5:52am. Epstein’s body was found at 6:30 am. In a 2021 sworn statement to DOJ investigators, he said he did not remember the search and questioned whether the digital logs were accurate.

In November 2019, Chase Bank filed a suspicious activity report with the FBI flagging 12 cash deposits into Noel’s personal account dating back to April 2018. The largest, $5,000 in cash, arrived on July 30, 2019, 10 days before Epstein’s death. Total deposits flagged came to over $11,880. Noel was also paying for a $62,000 2019 Land Rover Range Rover. He was not asked about the deposits in his DOJ interview. The origin of the money has never been publicly explained.

An internal FBI document identified Noel as the figure seen on surveillance video carrying the linens toward Epstein’s cell at about 10:40 p.m. the night before his death. That was the last time any correctional officer was recorded approaching the door of his unit. Noel said in his sworn statement that he did not give linen to the prisoners. Epstein was found hanging from orange cloths. The 2 cameras outside his cell did not produce usable video. MCC’s recording system malfunctioned on July 29 and was not repaired.

The Chief Medical Examiner of New York ruled that Epstein committed suicide by hanging. The FBI and DOJ inspector general’s 2023 report found no evidence of criminal involvement beyond the falsified records. Noel has denied any involvement in Epstein’s death and has not been charged with any crime related to it.

He had been incarcerated at MDC since April 2019 and moved to H-tier MCC in late July, a few weeks before Epstein died. His cell was the first on the right. In it he could see microwaves, a lounge and a guest room. He could hear what the guards were saying, including at their desks. He was there when Noel served dinner on the night of August 9. He was there when the food cart pulled in the next morning. He was there when the words began.

His name has not appeared in any of the reports. He gave this account to an FBI agent 18 days after Epstein’s death and, according to the public record, it was.

The FBI document is document EFTA00098091. A handwritten summary, not a verbatim text. The agent recorded his account in writing, moving between topics, sometimes without a clear transition between who said what. Many words in the document have been rewritten.

  • In custody since 4/16/19 at MDC, H-tier for about 6 weeks. The first cell on the right.
  • You can see the microwave, the lounge, the guest room from the cell. You can hear what the guards are saying, including the desk.
  • The numbers should be 4, 10, 12, 3, 5 during the week; 10am on weekends.
  • The police just walk past the cell, sometimes without even looking inside. Some police officers don’t do math overnight.

Previous houses:

  • It was in 6-tier (single cells) from 6/8 to mid-July.
  • Arrived at MCC on 6/13. He was sent to suicide watch because he asked for blankets and cleaning supplies. There were dead rats on the floor of his cell. The guards weren’t bringing anything. The window was covered with a sheet and he was taken to the suicide watch for about 1 day.
  • Restored to 6-tier. They were given a blanket and soap. I didn’t have any cleaning supplies.
  • No one made it to 6-tier, not even the advisors. The policeman said “I thought you were famous up here.” The only time he saw anyone was when the lieutenant was feeding. Some days the officials count, other days they don’t even look. The only way to get official calls is when the lieutenant comes through.

Move to H-Tier:

  • Mid to late July, moved to H-tier. Children with behavioral problems were flood cells and were relegated to H-tier and other tiers.
  • She does not have a partner.
  • The only time he saw officials in H-tier before Epstein died was when the food arrived. Breakfast at 6am. Lunch should be at 11am, come 1-2pm. Dinner should come at 5pm, sometimes 6:30-7pm.

  • He eats cold food every day.
  • Usually after 10pm, the police ask to turn off the lights. He usually looks at everyone at the door because his is the first cell. If not, he listens to the radio, works, reads a book.
  • Usually sleeps from 12-3am, works at 3am, then sleeps.
  • It has an open hole under the sink with water bugs and mice coming in.
  • I never saw the midnight rounds before Epstein died.

Officer definitions (several words redacted):

A conversation about Noel was overheard:

  • One time [redacted] he was listening at the door around 5pm. Noel once [redacted] they were talking. [Redacted] said [the inmate] he was loud. Before that, he saw Noel trying to apologize. [Redacted] he said “who?” Noel said “a molester, a rich man.”
  • Noel never made rounds. If they have worked a shift before they know the number of the next shift.

Other officers (invented names):

  • [Redacted] usually works during the day. You are a PIC. [Inmate] you think you are investing in people.
  • [Redacted] he told [redacted] that he met with the prosecutors and the prosecutors asked about it [redacted]. It has been told [redacted] he was stupid in practice. Now they are given less food. [Inmate] you think it’s revenge.

Alleged police misconduct (names withheld):

  • Saw [redacted] plant drugs twice. Children charged with BMB. [Redacted] he wanted dice from the children. Then a pack of cigarettes was found on the child. It was a new package but the baby was only 2 weeks old. [Inmate] know that the child does not have it because he smokes. 2016, Indiana: a child went to the SHU, another was declared “sick.”
  • In 5-tier, he saw [redacted] enter the baby cell and find K2. But the child did not smoke K2 and did not have a cellmate.
  • [Redacted] he didn’t make the rounds. We only saw [redacted] go the distance after Epstein’s death.
  • [Redacted]: an officer. He spends most of his time thinking that he is untouchable.
  • [Redacted] the problem is because you beat people in their cells. When [inmate] he was watching suicide, [redacted] he said to him “don’t do that again, I will fire you.” Short, dark-skinned, do-rag. Works at midnight. It counts but not rounds. He doesn’t care about rounds. I have never heard of him and drugs.

Epstein died last night:

  • Dinner was served by Noel and one other officer.
  • I never heard the trays being removed.
  • He came around 10pm to count. [Inmate] he asked to turn off the lights and he did so.
  • At midnight, everyone was kicking the doors and shouting, asking for the lights to be turned off. A new police officer entered. It told it not to roll. Some guys in the section say “[she’s] he’s lazy, he just wants to sit down.” [Redacted] he said he had to get up and turn off the lights. He said it was audible to everyone. [Redacted] he did not repeat what he said.

  • Sometimes officials [redacted] say Saturday/Sunday they have nothing for you.
  • After the new policeman came in at midnight, he turned on the fan (or air) and shut off the noise.
  • Sleepy. He got up and went back and forth.
  • A food cart was brought in.
  • Then there was a sound of “breathe! breathe!” Other policemen entered.

Statements heard after the results:

  • When they left with breakfast, Lieutenant [redacted] he served food and asked some of the food workers: “Kill that man.”
  • He said: “If he’s dead, we’ll shut it down, and you’ll have any police officers simulating the conversation.”
  • The whole tier heard that. Then [redacted] started a conversation.
  • It was discovered in the news that Epstein had died.
  • The police kept saying “I didn’t kill him.”
  • When the people came out, the prisoners said: “Miss Noel killed Jeffrey.”

Some officials note:

  • Lieutenant [redacted]: he never rubs [inmate] the wrong way. He makes rounds but doesn’t walk on the scale. It goes to 10S, and it goes away.
  • [Redacted] (tall, bells): defined as “a wimp.” From [redacted] place. When it comes to touring, that’s why phone calls and things come in. MDC is very technical.
  • [Redacted] he doesn’t care what goes in. He searches but says “I don’t care what you bring in.”
  • [Redacted] talking to inmates and family members and rubbing it in your face, but other officers do.
  • Officer [redacted] he said, “You have spoken [redacted]. You’re lucky I didn’t punch you in the face.”
  • Lieutenant [redacted]: bad officers.

  • After Epstein’s death, they put the pad right there [inmate’s] the door where the officials have to sign when they go around. They are making the rounds now.
