Their lawyers warned them, separately, that having a child together after separation could have “legal consequences”. They read the warning, signed it, and decided to try it anyway.
Jelly Roll and Bunnie Xo were told by their lawyers not to have children together as a divorced couple, according to a divorce settlement obtained by PEOPLE.
Lawyers have flagged the “consequences” for the child together “due to emerging technology and case law; and the ‘temporary phase’ of the benefit conferred on said genetic material.” Both sides also acknowledged that their attorneys are not experts “on genetic and reproductive rights,” and that they were “directed and advised” to consult with qualified experts outside of their legal team. Court filings say the two “chose not to seek that advice.”

The couple, who are childless and had planned to adopt another via surrogate, finalized their divorce just weeks before what would have been their 10th wedding anniversary. Jelly Roll, whose real name is Jason DeFord, filed on May 18, expressing irreconcilable differences, with a separation date of May 9. They got married in Las Vegas in August 2016.

He is also father to daughter Bailey Ann and son Noah Buddy from a previous relationship.

Bunny Xo, whose real name is Alisa DeFord, said the two still hope to raise a child together on the June 18 episode of her Dumb Blonde podcast. “So, we were the oddest couple you ever met,” she said. “We’re going to be a parent together. J is my best friend. Like, this is not what you think it is. No one cheated on the other person. We actually fulfilled our purpose with each other.”

She had already written about the show, and named her spouse, in her memoir Stripped Down, which was published in February.
